Terms of Use

The rules for using jmaany.org and interacting with the Jose Marti Alumni Association New York, Inc.

Welcome to jmaany.org (the "Site"), operated by the Jose Marti Alumni Association New York, Inc., a New York 501(c)(3) nonprofit corporation ("JMAANY," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the Site.

By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who we are

JMAANY is a volunteer-run alumni association incorporated in the State of New York whose mission is to support current and former students of José Martí Technical High School (JMTHS) in Kingston, Jamaica through scholarships, mentorship, community service, and reunion programs.

2. Eligibility

You must be at least 13 years old to use the Site. Membership is generally open to JMTHS alumni, family of alumni, faculty, and supporters, subject to the tier eligibility rules described on our Membership page.

3. Membership accounts

  • You are responsible for keeping your username and password confidential and for all activity under your account.
  • Provide accurate, current information when you register or update your profile.
  • Membership dues are voluntary contributions to a nonprofit and are not refundable except as described in Section 6.
  • We may suspend or terminate accounts that violate these Terms or that harass, defraud, or harm other members.

4. Donations

  • All donations are processed by PayPal. We do not handle payment card data.
  • Donations to JMAANY are tax-deductible in the United States to the extent allowed by law. JMAANY is a 501(c)(3) organization (EIN available on request).
  • Program-designated donations (for example, to the Scholarship Fund, Sports Program, or Nutrition Program) will be used for that program. If a program is fully funded, discontinued, or does not receive enough total support to be viable, JMAANY's board reserves the right to redirect the donation to a similar program or to general operations.
  • You are responsible for entering the correct amount on PayPal. We rely on the amount PayPal reports to us.

5. Recurring memberships and subscriptions

  • Monthly and yearly memberships renew automatically through PayPal until you cancel.
  • You can cancel a recurring PayPal subscription at any time from your PayPal account (Settings → Payments → Automatic Payments), or by emailing us at info@jmaany.org.
  • Cancellation stops future charges but does not automatically refund past dues.

6. Refunds

Because donations and membership dues support charitable programs, they are generally non-refundable. We will, however, honor refund requests made in good faith within 30 days of the charge for the following reasons:

  • Duplicate or accidental payment.
  • Charge amount does not match the amount you intended to give.
  • Unauthorized use of your PayPal account (please also report this to PayPal).

To request a refund, email treasurer@jmaany.org with the PayPal transaction ID and the reason. Refunds are processed back to the original PayPal account.

7. Scholarships, mentorship, and program applications

  • Program eligibility criteria, selection processes, and award amounts are described on the relevant program pages and in the application materials themselves.
  • Submitting an application does not guarantee selection. All decisions of the JMAANY Scholarship or Program Committee are final.
  • You represent that all information in your application is true and complete. Misrepresentation may result in disqualification or, if an award has been made, revocation and return of funds.

8. Acceptable use

When using the Site, the Members Portal, or any JMAANY communication channel, you agree not to:

  • Post or transmit content that is unlawful, harassing, defamatory, obscene, or infringes anyone else's rights;
  • Impersonate any person or misrepresent your affiliation with JMTHS or JMAANY;
  • Attempt to gain unauthorized access to any part of the Site, other accounts, or our systems;
  • Introduce viruses, malware, or automated tools that interfere with the Site;
  • Scrape or harvest personal information from the Site;
  • Use the Site for commercial solicitation of members without written permission from JMAANY.

9. User-submitted content

If you post comments, photos, biographies, event descriptions, or other content to the Site or Members Portal, you grant JMAANY a non-exclusive, worldwide, royalty-free license to display, reproduce, and adapt that content for the purpose of operating the Site and promoting the Association. You retain ownership of your content. You represent that you have the right to post it and that it does not violate anyone's rights.

10. Intellectual property

The Site's design, text, graphics, logo, and other content (except user-submitted content and content used under license) are the property of JMAANY or its licensors and are protected by U.S. and international copyright and trademark law. You may not copy, republish, or create derivative works without our written permission, except for personal, non-commercial use.

11. Third-party links and services

The Site links to third-party services including PayPal, YouTube, and social media platforms. We do not control and are not responsible for those services. Your use of them is subject to their own terms and privacy policies.

12. Disclaimers

The Site and all information on it are provided "as is" and "as available." To the fullest extent permitted by law, JMAANY disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected.

13. Limitation of liability

To the fullest extent permitted by law, JMAANY, its officers, directors, volunteers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Site — even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the Site will not exceed the greater of (a) the amount you paid to JMAANY in the 12 months before the claim, or (b) US $100.

14. Indemnification

You agree to indemnify and hold harmless JMAANY and its officers, directors, volunteers, and affiliates from any claim, liability, damage, or expense (including reasonable attorneys' fees) arising from your breach of these Terms, your use of the Site, or your violation of any law or third-party right.

15. Governing law and dispute resolution

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Nassau County, New York, and you consent to the personal jurisdiction of those courts.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Continued use of the Site after changes are posted means you accept the revised Terms.
